A legal guardian is an individual who is legally responsible for the well-being and care of a minor, or in some cases, of an adult who may require assistance.
US - EpiMonitor users under the age of 13 are required to provide Empatica with their legal guardian’s verifiable consent, as the U.S. Children’s Online Privacy Protection Act (COPPA) requires us to obtain it before we collect their personal information.
EU - For users in Europe under the age of 18, Empatica will require you to provide a legal guardian and sign a consent form to complete the account creation process.
Legal Guardian rights and responsibility
If you are the registered legal guardian and are contacting us on behalf of the user, we will be able to disclose any account information to you and make any requested updates for the user’s account.
Just note that all communications from Empatica (e.g. system updates, order status, special offers) will be sent to the user’s registered email address, which is the email used for the account login. Therefore, please remember to check the user’s inbox regularly to stay informed of any updates regarding our system or the user’s account.
What happens if you do not have your Legal Guardian Consent?
You will not be able to use or log in to the EpiMonitor App if you do not receive your legal guardian’s consent.
Without their consent, you will only have access to the EpiMonitor Account Portal to resend the request to your legal guardian for consent, update legal guardian information, and manage your order.
Once they have provided their consent, you will see the status changed to “Legal Guardian: Consent given” and you will be able to log in to the EpiMonitor App and proceed with the setup of your EmbracePlus.
